Just Issues Injunction on Trump’s Asylum Ban
A federal judge has blocked the Trump administration from banning asylum at the southern border.
According to The Hill:
A federal judge in California on Monday reinstated a ban on a Trump administration policy that would restrict migrants’ ability to apply for asylum at the southern border.
AdvertisementU.S. District Judge Jon Tigar had issued a nationwide injunction in July blocking the rule, which would make most asylum-seekers who pass through another country before reaching the U.S. ineligible for asylum, with exceptions for victims of trafficking and migrants who have been denied asylum in the countries they traveled through.
The rule would primarily effect Central American immigrants crossing through Mexico.
The Ninth Circuit Court of Appeals upheld Tigar’s initial ruling but narrowed the injunction to only border states within its jurisdiction — California and Arizona — before sending the question back to Tigar.
The Trump administration has asked the Supreme Court to lift this injunction which applies nationwide.

The majority of citizens of CA actually have no say in the passage of this detrimental laws because only the Liberal strongholds of LA and SF our state legislatures that hold the majority (smaller areas do elect as many conservatives as possible, but not enough to override the Liberals) and the same goes for our votes for Congressional candidates. There are many disgruntled Conservatives and even Liberal taxpayers who are being ignored while more and more taxes are loaded on us to pay for the freebies and programs that only benefit illegals. We have a horrendous homeless population here that includes Veterans and people who have been priced out of housing including rentals because of the high salaries of companies in Silicon Valley and similar areas…who can afford homes in the million dollar price range? Even the half million dollar price range and rents that exceed 1/2 of your monthly income? Seniors lose their homes or end up having to sell them or do reverse mortgages because of property taxes, gas taxes, food prices constantly increasing, utilities (including water) soaring and increases constantly being granted, and on and on and on. More and more taxpayers are leaving CA because they cannot afford to live or survive here. That is not how it is suppose to be for millions of Californians that go back generations or those who came here in the 40’s and 50’s or even 60’s when things were completely different, had their families, and now their kids and grandkids are having to move away. I love many things about CA and came here at 7 years old, 62 years ago, and don’t want to leave, but I am looking for somewhere to move so that my retirement income (once more than adequate) will be enough to live on until my time on earth ends. My kids are also looking to move out. It is sad to think that we must leave other family members and be separated y different states instead of being near enough to visit each other with a few hours of driving or living right in the same area.
So don’t blame all the people of CA. We would love to see the state split into northern and southern CA and I would immediately head for the north to get out of the hell that the Liberals are creating here!

Need to vote all them out first, & when Patriots control the House, then impeachment of all Obama-appointed judges can commence. If that doesn’t occur, there is no hope for at least 20 years, when they start to die off.

To you does ‘American’ = Republican conservative? Some of the greatest aspects of the United States of America are the freedom to have our own beliefs and perspectives, AND the freedom to express them. Some of us are Liberal, some Conservative. And having a different social/political outlook does not make either of us “Un-American”.
In terms of the 9th Circuit’s ruling on this particular issue, let’s talk about what’s American. First, we have Laws, and (most of us) believe in and follow the Rule of Law. Well, many years ago the US and about 180 other countries met to discuss the world’s refugee crisis (after millions were displaced during WWII), and came up with an International Treaty, known as the Refugee Compact. All of the countries that helped develop it and signed agreement to this Treaty agreed to abide by its principals and laws, which formed the basis for both International and US Asylum Law.
Those laws state that any person who has feet on the ground in any of those ~180 countries may request asylum – basically safe haven, and the receiving country MUST 1. allow the person to apply, 2. schedule a hearing to evaluate the person’s claims of persecution or credible fear of persecution, based on religion, race, political beliefs, and/or membership in any particular social group, and allow the person to stay in the country until the conclusion of said hearing and potential appeals. The person’s family may stay with him/her. The burden of proof of persecution or credible fear of persecution is on the applicant, and most do NOT get approved. Nonetheless, the law requires the country to allow the person to apply, allows the person’s family to stay with him/her, and prohibits the country from expelling the person prior to the conclusion of the hearing and appeals.. Furthermore, the person may apply anywhere in the country, as long as it’s within one year of arrival in the country, and HOW the person’s feet got “on the ground” is not relevant – if the person crossed over a border without permission, it isn’t held against him/her.
So, how is the US in violation? And why is the 9th correct in this judgment?
1. The US is bound by its own laws and by International Treaty to follow these laws, and
2. the law specifies that an asylum applicant be allowed to remain in the country (so sending them into Mexico to wait is illegal), and
3. the law specifies that the person’s family be allowed to stay with him/her (therefore removing children is illegal), and
4. saying we aren’t going to take asylum seekers, we don’t have any room, is illegal, AND
5. saying we won’t allow someone at our southern border to apply for asylum because they crossed through Mexico and should have applied for asylum in Mexico as a “safe country” is illegal (see below).
What credibility does the United States have if we don’t comply with an International Treaty, especially one that we helped develop?
The “First Safe Country” issue comes up frequently; after all, someone running for his/her life and the lives of his/her family doesn’t have the luxury of picking and choosing what country to stop in, s/he should just stop as soon as s/he has reached safety. So, that brings us to the determination of safe. There are specific requirements that must be met, AND, countries must reach agreements over which countries are or are not considered safe for this purpose. The United States and Mexico have been negotiating this for some time, and so far, the United States Federal Government does NOT consider Mexico to be a “Safe Country”. Therefore, we cannot legally deny people traveling through Mexico from requesting asylum because “they should have applied in Mexico”.
Now, back to your comments about “loyal Americans” and “un-American” – you do realize, of course, that this is a diverse country with many types of people and many perspectives. “Loyal Americans” aren’t all the same as the others. We elect our representatives to represent us and our justices are elected or appointed to interpret and apply the rule of law. We may not – will not – all agree with our representation or their decisions, but as loyal Americans we hope and trust that they all take various and sometimes conflicting information, ideas, precedents, and laws into account during their decision making. The fact that you disagree with this Court and with California doesn’t make either disloyal or un-American. To use a cliché, we are part of ONE diverse country, and as such, we need to recognize that we must often agree to disagree.

(He has trampled on it in a number of instance: On the First Amendment’s protection of Religion, with his “Muslim Ban”, on the First Amendment’s protection of speech and protection of expressing grievances with his negative comments and stance toward athletes peacefully expressing a grievance about a problem in our great country, he has violated the Domestic Emoluments Clause by profiting from the stays of government personnel at his properties, and, just the same, he ha violated the International Emoluments Clause by profiting from stays of foreign government personnel at his properties, AND by continuing to make deals with foreign governments, which will lead to great profit for him: example, a deal for China to finance a Trump theme Park in Indonesia, would have netted him multi-millions (China backed out of the deal). Rather than putting his business interests in a truly blind trust, he continues to be involved, and uses his position as president to the advantage of his business deals and hence personal profit.

As this is a National question it is altogether fitting it go to the Supreme Court for decision. Its ruling carries a legal weight so impressive even a Obama(Obanonoma/Banamana) rule by executive decree cannot overturn.

This Court has ruled according to the Law – our own and longstanding International Law, both based on International Treaty of which we are a co-developer and signatory and to which we are legally bound.
The Court has both brains and integrity. Be aware that the vast majority of brown-skinned Spanish-speaking people who would like to immigrate via our Southern order are good people – individuals and families who are hard working, family loving, and God-fearing Christians, who simply want what YOUR AND MY AND EVERYONE’s ancestors wanted, as they trekked, swam, rode, sailed, and rowed around the globe, spreading humankind all over our shared planet: a safer and better place to raise their families. If not, we’d still all live in Morocco (as archeological research now suggests).

Our ‘representative’ Jared Huffman refused to go to the Inauguration, SOTU. Straight Dem votes on every issue. We wanted the state of Jefferson, the north, NOT including San Fran or Sacto. They kept pushing San Fran on us to that it would control the north. Last year alone, there were 3 gasoline tax hikes on what were already the highest gas prices in the US. Every illegal alien has a place to live, and we have 1/2 of all the homeless in the US living in the streets everywhere. The dems have tied the police’s hands so they can do nothing. People in the streets are shooting up heroin and leaving their syringes in the parks where children used to play. We desperately need shelters combined with drug treatment programs, but all the money goes to illegals. And now, free college. The dems in office don’t care. They live in gated communities, have cadillac healtcare, and retirement on full salary. The people pay the taxes, live in increasingly expensive regular housing, and with no infrastructure repair since Brown was elected. We do have a half-finished high speed railway they can’t afford to finish. It’s now a homeless encampment.
